PRIVACY NOTICE AND EXPRESS AUTHORIZATION FOR THE PROCESSING OF PERSONAL DATA
EVERFIT S.A., in compliance with the Law 1581 of 2012, the Regulatory Decree 1377 of 2013 and our Personal Data Protection Policy, informs you that the personal data that you provide, will be treated through the use and maintenance of technical security measures, physical and administrative to prevent unauthorized third parties to access them. The person responsible for the processing of your personal data is EVERFIT S.A. established in Medellín and located in Transversal 78 65-233, who will collect them through its different networks and will be used for the activities that are stated below, either by direct relationship with the Subscriber or through his Employer. In virtue of the aforementioned, in my capacity as the owner of the information, I declare that I have been informed: (i) That EVERFIT S.A. hereinafter ¨EVERFIT¨, will act directly or through third parties as the person responsible for the processing of my personal data and has placed at my disposal the e-mail infodatospersonales@everfit.com.co and customer service offices nationwide, whose address is Transversal 78 65-233, Barrio Caribe Medellín, available from Monday to Friday from 7:00 am to 5:00 pm, for any attention on requirements related with the processing of my personal data, and the exercise of the rights mentioned in this authorization; (ii) My data will be processed for pre-contractual, contractual, post- contractual and commercial purposes, directly with the Subscriber or with my Employer for customer service and marketing purposes, data processing, research, certification, data consolidation, organization, updates, reports, statistics, surveys, attention and processing; ( iii) My rights as the owner of the data are those provided in the Constitution and the law, specially the right to know, update, rectify and eliminate my personal information, as well as the right to revoke the consent granted for the processing of personal data. These rights can be performed through the networks available by EVERFIT for customer service and observing the Personal Data Processing Policy available in http://www.EVERFIT.com.co; (iv) It is volunteer, to answer the questions that occasionally could be made regarding sensitive information which will be treated respecting my essential rights and superior interests. It is considered sensitive data, those that affect the privacy of the Owner or whose incorrect use may generate discrimination. Considering the above, I authorize voluntarily, prior, explicit, informed and unequivocal to EVERFIT and to whom the rights are conceded, to process my personal data, with the main purpose of contracting, executing and commercializing the goods and services of the Responsible of the Processing, as well as the contract through telephone and electronic media (SMS, chat, e mail and other media considered electronic) physical and/ or personal. EVERFIT may use my data for the following purposes: 1.To execute the necessary arrangements for the development of the pre contractual, contractual and post contractual step, held directly with the subscriber and/ or with my EMPLOYER and third parties that contract with him, regarding any of the products and services offered that had acquired directly or through my EMPLOYER, regarding any business or commercial relationship that EVERFIT has, as well as complying with the Colombian or foreign law and the orders of judicial or administrative authorities. 2. To conduct invitations or announcements to events, to improve offered products and services or offer new products, and all those activities associated to the commercial relationship or existing link with EVERFIT directly by the Subscriber or trough my EMPLOYER or third parties that contract with him, or that I will have. 3. To manage procedures (requests, complaints, claims), to make risk analysis, to carry out customer satisfaction survey regarding the goods and services of EVERFIT, as well as the commercial allies of EVERFIT, also carrying out based on the data provided by me, market studies, demographics, and others that have a strategy in the development of its social object; 4. To provide contact information, residential address, birth data, information derived from a process of taking sizes and other information and documents pertinent to the commercial force, market research that EVERFIT has in development of a commercial relationship directly with the Subscriber or through my EMPLOYER. 5. To disclose, transfer and/ or transmit my personal data inside and outside of the country, to any company or to third parties because of a contract, law or lawful link that so requires, or to complement the logistic services within the development of a business relationship directly with the Subscriber or through my EMPLOYER. For all the above, I grant my express and unequivocal authorization. 6. To transfer or transmit the data to the parent companies, subsidiaries, controlled of EVERFIT or its service providers, inside or outside the country. 7. To create data bases for the purposes stated in this authorization. I authorize EVERFIT to modify or update its content to address legislatives reforms, internal policies or new requirements for the provision or offering of services or products, previously notifying through the company´s web site or by e mail.
